Terms of Service
Effective date: October 22, 2026
Last updated: October 22, 2026
These terms cover your use of the Tap-In app, the gym dashboard at app.thetapinapp.net, and the website at thetapinapp.net (together, "Tap-In"). Tap-In is a trade name of Famedia LLC, a New York limited liability company ("Tap-In," "we," "us"). By using Tap-In you agree to these terms and to our Privacy Policy. If you don't agree, don't use Tap-In.
Please read section 15. It explains how disputes are resolved, including arbitration and a waiver of class actions.
1. Who can use Tap-In
You must be 18 or older. You must give accurate information when you sign up and keep your sign-in email secure. You are responsible for activity on your account.
2. How Tap-In works
Gyms pay for Tap-In. Members use it free through their gym by tapping a Tap-In stand at their gym to join. A gym's use of Tap-In is covered by its own agreement with us, and these terms don't change that agreement.
You start a workout with a tap on a stand or from the app, and end it with a tap, the End button, or by leaving your gym. While a workout is running, the apps you chose are blocked. Calls and texts stay live during every workout.
Tap-In works only through a gym. If you're no longer a member, you can't start new workouts, but your history stays yours.
3. Your gym membership in Tap-In
- Your gym can remove you from its Tap-In member list, for example when your membership ends. You can join again with a tap at a gym that uses Tap-In.
- If your gym stops using Tap-In, its gym features end. Your account and your session history stay yours.
- Your gym sees your name, your join date, and totals across its members, as described in the Privacy Policy. It never sees your individual sessions. If you join the leaderboard, your gym and its members also see your display name and days trained.
4. Blocking, emergencies, and limits
- Blocking runs on Apple's Screen Time. Apple controls how it works, and we can't guarantee that every app or website is blocked every time.
- You can end a normal workout any time with the End button. In challenge mode, which you choose, the workout holds until you tap out at a stand, and a limited number of emergency unlocks are there if you need one.
- Tap-In ends a workout when you leave your gym (with location on), and may end a long workout after a check-in.
- Tap-In is not an emergency service. Don't rely on it to reach or be reached by anyone. Calls and texts stay live, and you can always end a session.
5. Stands and taps
The stands at your gym hold secure tags that we install and maintain. You agree not to:
- copy, move, damage, or remove a stand or its tag;
- fake a tap, replay tap data, or send a tap from anywhere other than a real stand;
- change, reverse engineer, or interfere with the app or our servers;
- fake your location or a tap to make a workout count.
Taps that fail our checks are not counted. We may suspend accounts involved in faked taps.
6. Challenge mode and the leaderboard
Both are optional. Choose a display name that doesn't impersonate anyone and isn't offensive; we or your gym may remove a name or a member from the leaderboard. Rankings are for fun. Any prize is between you and your gym.
7. Gym staff accounts
If you use the dashboard for a gym:
- use it only for the gym you were given access to, and keep your sign-in secure;
- use member names only to manage your gym's member list;
- don't try to work out an individual member's activity from the totals;
- add a member by hand only when they ask, and moderate the leaderboard fairly.
Your gym is responsible for who it gives dashboard access to.
8. Health and fitness
Tap-In is a training tool. It does not give medical advice and is not a substitute for a doctor. Talk to a doctor before starting an exercise program. You exercise at your own risk.
9. Apple Health and Screen Time
Tap-In uses Apple's Screen Time to block apps and, with your permission, Apple Health to show and record workouts. How we handle that data is in the Privacy Policy. You can turn either off in your iPhone's Settings, but blocking needs Screen Time to work.
10. The App Store
You download the app through Apple's App Store, and Apple's terms also apply to your use of it. Apple is not responsible for the app or for support. If these terms and Apple's terms conflict about your use of the app, Apple's terms control where the law requires.
11. Our content and your feedback
Tap-In, including its name, logo, app, website, and content, belongs to Famedia LLC or its licensors. We give you a personal, non-transferable right to use Tap-In under these terms. If you send us ideas or feedback, we may use them without owing you anything.
12. Acceptable use
Use Tap-In lawfully. Don't use it to harass or harm anyone, send spam, impersonate anyone, upload harmful code, collect other people's information, or get around any security or access control. Don't access Tap-In with bots, scrapers, or other automated tools without our written permission.
13. Disclaimers
TAP-IN IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT TAP-IN WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT BLOCKING WILL ALWAYS WORK. SOME PLACES DON'T ALLOW THESE DISCLAIMERS, SO THEY MAY NOT ALL APPLY TO YOU.
14. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, FAMEDIA LLC AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF TAP-IN. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM.
15. Disputes
Before filing any claim, email info@thetapinapp.net and describe the dispute. We'll try to resolve it within 30 days.
If we can't, any dispute about these terms or Tap-In will be resolved by binding arbitration under the rules of the American Arbitration Association, not in court. Either of us may bring a claim in small claims court instead. You and we each give up the right to a jury trial and to bring or join a class action. Either of us may ask a court for an injunction to prevent irreparable harm.
16. Governing law
New York law governs these terms, without regard to its conflict of law rules. Any dispute not subject to arbitration goes to the state or federal courts in Nassau County, New York.
17. Ending your use
You can stop using Tap-In and delete your account at any time. We may suspend or end your access if you break these terms, with notice where the law requires. Sections 8, 11, 13, 14, 15, and 16 continue after your access ends.
18. Changes
We may update these terms. If a change is significant, we will tell you in the app or by email before it takes effect. Using Tap-In after that means you accept the new terms.
19. General
If part of these terms can't be enforced, the rest still applies. Not enforcing a right is not a waiver of it. These terms and the Privacy Policy are the whole agreement between you and us about Tap-In, except that a gym's own agreement with us governs the gym. You can't transfer these terms; we may transfer them as part of a business sale or merger.
